Wakefield Couple Asks Court to Throw Out Child Porn Evidence

Lawyers for John and Marian Burbine say police didn't follow proper procedure when collecting a large cache of child pornography that will be Exhibit A in the couple's upcoming trials.
John Burbine stands accused of 100 counts of child sex abuse and separate charges of child rape. His wife, Marian, is also awaiting trial on six counts of reckless endangerment of a child for operating an improperly licensed day care where her husband worked.
In a Woburn court on Friday, prosecutors stood by the police handling of the search of the Burbine's home, according to Patch news partners News7.
